1. Goods and Services
1.1 We will always endeavour to describe the items we sell with the utmost care.
1.2 We want you to be completely happy with your purchase, so please feel free to e-mail us if you have any questions about a product prior to purchase.
1.3 If you have any problems with a purchase please contact us. We treat our customers as we would like to be treated and want you to return in the future, therefore we will do our utmost to sort out any problems to your satisfaction.
1.4 Items broken in the post will be replaced or refunded, if returned to us within 14 days. We will refund the return postage up to a maximum of £10. You must inform us before returning items as unauthorised returns can not be accepted.
1.5 Under the distance selling regulations you have the right to cancel your order within 7 days of placing it, if you decide to do this you must return the item to us at your own expense before a refund will be given.
2. Payment and Postage
2.1 All prices include VAT.
2.2 Any item you chose to buy will remain the property of HandcraftedUK until payment is received in full. We do not offer credit terms so please do not ask us to.
2.3 Please ensure you have checked the Shipping & Returns section for information on delivery prices. Payment is accepted by credit and debit cards. If you wish to pay by any other method please contact us before ordering to ensure this is possible.
2.4 Unless
express
delivery is selected, orders totalling less than 1.25kg in weight will be sent
using Royal Mail first or second class post (depending upon the shipping option selected at checkout). The majority of Royal Mail
first-class deliveries arrive within 1 working day
of dispatch and the majority of second-class deliveries arrive within two working days. However, please allow 15 working days for your order to reach
you. Royal Mail do not consider an item as missing before 15 days has
elapsed so HandcraftedUK can not pursue a claim for missing mail during
this period. If express delivery was selected, please see clause 2.6. For orders totalling over 1.25kg in weight please see clause 2.7. For international deliveries, see clause 2.8.
2.5 We aim to ship all first class and standard deliveries within the time scales specified in our shipping & returns section. However, dispatch may be delayed if we experience increased demand. For first class deliveries we will contact you within 2 working days to inform you of any delays. For standard deliveries we will contact you within 3 working days to inform you of any delays.
2.6 If our express delivery service was selected, orders
placed before 1300GMT will arrive next working day. Orders placed
after this time will arrive within two working days. All express
deliveries are sent via FedEx courier or, Royal Mail special delivery. If your order has not reached you within one working day then please contact us. Valid for UK mainland addresses only. A working day is Monday-Friday (excluding bank holidays).
2.7 Orders totalling over 1.25kg in weight will be sent using FedEx courier services. FedEx aim to deliver within 1-3 working days
of dispatch (depending upon the shipping option you selected at checkout). If your order has not reached you within this time period please contact us so we can track the progress of the delivery.
2.8 For international deliveries please see the shipping and returns section for details on delivery time-scales.
2.9 While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
2.10 On receipt of your payment you will be sent confirmation by e-mail. Next your item will be carefully packed and shipped out to you on the next available posting slot. This is usually within 72 hours of receipt of payment, though this may change if we experience increased demand.
2.11 We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
3. Returns
3.1 We offer a 14 day money back guarantee, please refer to the Shipping and Returns section for details.
3.2 All sizes and measurements are approximate but we do try to make sure that they are as accurate as possible.
4. Intellectual Property
4.1 You acknowledge and agree that the material and content contained within this website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this website. You further acknowledge that any other use of the material and content of this website is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
5. Liability and Indemnity
5.1 Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.
5.2 Subject to Section 5.1 above, HandcraftedUK will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the website HandcraftedUK will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and HandcraftedUK accepts no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.
5.3 Subject to Section 5.1 above, HandcraftedUK will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent on negligent misrepresentations) or otherwise out of or in connection with the terms and conditions for any:
economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or
loss of goodwill or reputation; or
special or indirect losses
suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.
5.4 Notwithstanding the above, subject to Section 5.1 HandcraftedUK's aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.
5.5 This clause 5 does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.
5.6 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
6.Privacy Policy
6.1 Any personal information collected from you with regard to your order will be used solely in connection with that order. Please note that a paper or electronic copy of your invoice may be kept for our accounting purposes only.
6.2 The exception to this shall be if you chose to sign up to our newsletter, or you register for an account with us, in this case your information will be kept solely by us and used to send you offers and information that may be of interest to you.
6.3 You can ask to be removed from our mailing list, or to have your account records closed and deleted at any time by emailing us at the contact address supplied on the website.
6.4 Your information will not be revealed to any other individual or organisation unless you give us your express permission to do so (such as for example if we undertake to do cross over promotions with fellow companies in the future, in which case we would mail you for permission).
6.5 Your information will never be sold to third parties under any circumstances.
7. Miscellaneous Provisions
7.1 The contract between us shall be governed by the laws of England and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.
7.2 We have selected our products on the basis that they will be used for domestic use only, if you are planning to use them for business purposes please make sure that you are covered by the appropriate insurance. Where you decide to use the products in the course of a business, we exclude (to the fullest extend permitted by law) those warranties and conditions relating to fitness for a particular purpose. Our maximum liability to business users arising out of or in connection with the products shall be limited to the replacement value of the product in question (except in the case of death or personal injury caused by our negligence or in respect of fraud). In relation to business users, we do not accept liability for the fitness of goods for business purposes, nor do we accept liability for loss of use of the item nor any loss over and above the cost of the item in the event of a claim for breach of warranty or condition.
7.3 HandcraftedUK shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.
7.4 If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.
7.5 No delay or failure by HandcraftedUK to exercise any powers, rights or remedies under these terms and conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing and signed by an authorised representative of HandcraftedUK.
7.6 These terms and conditions including the documents or other sources referred to in these terms and conditions supersede all prior representations understandings and agreements between you and HandcraftedUK relating to the use of this website (including the order of products) and sets forth the entire agreement and understanding between you and HandcraftedUK for your use of this website.
